General Terms and Conditions Swiss Sabers
- Scope
This website is operated by Swiss Sabers. Throughout the site, the terms “we”, “us” and “our” refer to Swiss Sabers Ltd. Swiss Sabers GmbH offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.
- Jurisdiction
Swiss law is exclusively applicable to the exclusion of the conflict of laws rules and the Vienna Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich.
- Products and prices
Images of products in advertisements and videos are for illustrative purposes and are not binding. The product images in the online store are tried to represent as realistically as possible.
All prices are in Swiss francs and include all charges for shipping, packaging and payments.
Prices are subject to change and errors excepted. We reserve the right to change prices of offered products at any time. The price in the online store at the time of the order is decisive for the conclusion of the purchase contract.
- Warranty, guarantee and returns
We grant a 14-day right of withdrawal on all products. In the event of damage before or during shipment, customers are entitled to a replacement of the affected items. If no replacement is available at the time of the warranty claim, customers have the option of requesting a refund of the purchase price or an equivalent replacement product at the same price. The damaged item must always be returned.
We also offer a 14-day right of return. Customers can exercise their right of return within 14 days of receipt of the item (delivery date), provided the item is unused, in its original condition and free from defects.
In accordance with Swiss law, we grant a warranty of 2 years from receipt of the lightsaber on the handle and the components inside (in particular the “soundboard” or the “core”).
The blade and battery are considered wearing parts and can be damaged during use (especially blades during fights). Therefore, there is no warranty for blades and batteries unless there is a defect upon receipt.
In the event of defects occurring after the warranty period has expired, a repair or replacement may be requested as a gesture of goodwill. However, Swiss Sabers reserves the right to deny this claim.
- Liability
The purchase contract is concluded with Swiss Sabers GmbH.
By placing the products in the online store, we make a binding offer to conclude a contract for these items. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.
For claims based on damages caused by us, our legal representatives or vicarious agents, we shall be liable for
- in case of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,
- in the case of warranty promises, if agreed, or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
- Delivery, shipping and collection
All our prices include shipping costs and VAT. We only ship within Switzerland and the Principality of Liechtenstein with Swiss Post. Parcels are generally sent by A Mail (Priority) and usually arrive within 1 to 3 working days of receipt of the order. We assume no liability for delays in delivery.
For items that are currently not in stock (marked “Not in stock”), a delivery period of more than 3 working days is to be expected. The buyer acknowledges that delays in delivery do not entitle him to refuse to accept the ordered goods.
Swiss Sabers is an online store. A self-collection of the goods is in Zurich Altstetten is only possible with appointment. Our warehouse location is communicated at the time of purchase.
- Transport damage
If goods are delivered with obvious transport damage, please complain about such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
- Payment
The following payment methods are available in our store. We reserve the right to change them or add more.
- Purchase on account (PowerPay, more information at www.powerpay.ch)
- Debit and credit card (VISA, Mastercard and others)
- Twint
- PostFinance Pay
For orders that are not picked up in person, advance payment is always required (with the exception of purchase on account). When picking up the goods, payment can be made on site with Twint or debit/credit card.
