2 Legal basis and terms

Data processing is carried out in compliance with the Swiss Data Protection Act (DSG) and, if applicable, the General Data Protection Regulation of the European Union (GDPR).

-Personal data:

This is any information relating to an identified or identifiable natural person (hereinafter “data subject”). It is therefore data that can be traced back to a person. This personal data includes first and last names, social media usernames, telephone numbers and email addresses. Personal data also includes information on hobbies, memberships and preferences as well as websites that have been accessed, including your IP address.

-Particularly sensitive personal data in accordance with the DSG

Personal data that is particularly worthy of protection within the meaning of the FADP:

-Data on religious, ideological, political or trade union views or activities,

-Data on health, privacy or racial or ethnic origin,

-genetic data,

-Biometric data that uniquely identifies a natural person,

-Data on administrative and criminal prosecutions or sanctions,

-Data on social assistance measures.

Data processing includes any handling of data (collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction).

 

3 Permissibility of the processing of personal data

According to the Swiss Data Protection Act, it is sufficient to inform users about the processing of personal data. For the processing of particularly sensitive personal data, however, the express consent of the data subject is required or the legislator must expressly authorize the processing. Consent can be revoked. Otherwise, it is sufficient to inform users about the processing of personal data.

If the EU GDPR applies, a justification is required for any processing of personal data (Art. 6 para. 1 GDPR). A justification exists if: 

– The data subject has given their consent to the processing of their personal data for one or more specific purposes (lit. a);

– The processing is necessary for the performance of a contract or for the implementation of pre-contractual measures, whereby the data subject is a contracting party or potential contracting party to the contract (lit. b); 

– Processing is necessary in order to protect the vital interests of the data subject (lit. d);

– The processing is necessary for compliance with a legal obligation (lit. e); 

– Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child (point (f)).

 

4 Scope, purpose and duration of the processing of personal data

– Scope and purpose

We process personal data to the extent necessary to carry out our activities and operations in a user-friendly, secure and permanently reliable manner. This includes in particular the recording, administration and processing of contracts.

Personal data may also be processed for communication purposes, in particular data transmitted by a data subject when making contact, for example by post, e-mail or contact form. We may store such data in an address book or with comparable tools.

We process personal data primarily on the basis of the data subject’s consent. We may refrain from obtaining consent if and insofar as the processing is permitted for other legal reasons. For example, we may process personal data without consent in order to fulfill a contract, to comply with legal obligations or to protect overriding interests.

– Involvement of third parties in Switzerland and abroad

We may have personal data processed by third parties. We may process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use. We also guarantee data protection for such third parties. Third parties who transmit data about other persons are obliged to guarantee data protection for such data subjects. Among other things, the accuracy of the personal data transmitted must be ensured.

If personal data is processed by third parties on our behalf, the contractor is obliged not to use the data provided for processing for any purpose other than that for which we ourselves are authorized. Information to third parties or the data subject shall only be provided with our prior consent as the client. 

We generally process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular in order to process it or have it processed there, provided that data protection can also be adequately guaranteed in these cases.

– Duration

We process and store personal data as long as it is necessary for the fulfillment of contractual or legal obligations or otherwise for the purposes pursued with the processing. As soon as this data is no longer required for the above-mentioned purposes, it will be deleted or anonymized as far as possible. Binding retention obligations are reserved.

 

5 Collection of general information when visiting our website (log files)

When you access our website, information of a general nature is automatically collected. This information (server log files) includes, for example:

8Data protection-related services of third-party providers used on this website 

In order to present our website as optimally as possible, to offer the best possible customer support and to be able to process orders securely and reliably via the website, products from the following third-party providers are used. We use in particular:

In order to display our content correctly and graphically appealing across browsers, we use “Google Web Fonts” from Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”) to display fonts on this website. Calling script libraries or font libraries automatically triggers a connection to the operator of the library. It is theoretically possible – although it is currently unclear whether and for what purposes – that the operator collects Google data in this case. We do not collect any personal data through the integration of Google Web fonts. – Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. – Google Tag Manager 

On our website, we use Google Tag Manager, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google. The Google Tag Manager itself (which implements the tags) is a cookie-free domain and does not process any personal data. The service triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation has been made at domain or cookie level, this remains in place for all tracking tags that are implemented with Google Tag Manager.

By using Google Tag Manager, scripts (so-called tags) can be automatically activated on our website and data can be transmitted from your browser to Google. This data may include information about your IP address, the browser you are using, the subpages of our website you have visited and other interactions during your visit to our website. 

 

– Google Site Kit

We use the “Google Site Kit” plugin, which is provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”), to manage and analyze our website. Google Site Kit enables us to integrate various Google services, such as Google Analytics, Google Search Console, Google AdSense and others, directly into our WordPress website and manage them centrally.

These servers may be located in the USA or other countries.

– Facebook Social Plugin

We integrate plug-ins of the social network Meta or Facebook (address: 1601 South California Avenue, Palo Alto, CA 94304, USA) on our websites.

If you access one of our websites with a Facebook plugin and are logged in to Facebook, a direct connection to Facebook will be established. We have no influence on the type and scope of data that is collected, stored and processed by Facebook. We can only inform you to the best of our knowledge.

– Matomo Analytics

We use the “Matomo Analytics” service on our website, which is provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand. Matomo is an open source software that enables detailed web analyses and places great value on protecting the privacy of users.

With the help of Matomo Analytics, we can analyze the behavior of our visitors in order to constantly improve the user experience and the content of our website. This includes information about which website a visitor comes from, which areas of our site they visit and how often and for how long they view these areas.

Matomo Analytics uses cookies to enable the analysis of user behavior. These cookies collect information in anonymized form, including the number of website visitors, where visitors have come to the website from and which pages they have visited. As Matomo attaches great importance to data protection, IP addresses are anonymized before they are saved.

One of the main reasons for using Matomo Analytics is data protection. Unlike other analysis tools, the data is not passed on to third parties.

 

– Shopping cart function (Cart Functionality)

Our website offers a shopping cart functionality that allows visitors to select products or services and reserve them for purchase. During this process, data about the selected products, the quantity and the total price can be saved.

To facilitate the purchase process, our website may also store information such as your name, delivery and billing address, e-mail address and other data relevant to the purchase. This data is used to facilitate the purchase process and provide you with a seamless user experience.

– WooCommerce with connection to the payment service zahls.ch, including the payment method Twint

WooCommerce is an open-source software from Automattic, Inc. located at 60 29th Street #343, San Francisco, CA 94110, USA. WooCommerce is an eCommerce platform that enables us to offer products and services on our website.

We use WooCommerce to manage our online store. This includes product presentation, the ordering process, payment processing and stock management. When using WooCommerce, users’ personal data may be collected and processed. WooCommerce is connected via the zahls.ch plugin for WooCommerce with the payment service from Switzerland provided by Siebenberge GmbH, Neu St. Johann. The data collected is used to process a sales contract via the online platform, including payment or preparatory actions for the possible conclusion of a contract. The data is also used for any subsequent customer support and, if necessary, for marketing measures. The data will not be passed on to third parties other than those who support us in the provision of services and sale of goods. Any use for our own purposes by third parties is excluded. Otherwise, data will only be passed on if we are legally obliged to do so. 

Collected data is included:

– Order data: Information on the products purchased, order numbers, transaction details and delivery status

– Customer data: Personal data such as name, e-mail address, delivery and billing address and telephone number provided during the ordering process.

– Payment data: Payment information is securely forwarded to the payment service providers we use. WooCommerce does not store complete payment data itself. 

– Technical data: IP address, browser type and version and other technical information necessary for the functionality and security of the website.

 

– Chat function via the communication platform of tidio.co 

For the live chat on our website, we use the Tidio service, provided by Tidio LLC, based at 149 New Montgomery Street (San Francisco, CA 94105 U.S.A.) and Tidio Poland Sp. z o.o., based in Szczecin, 81 Wojska Polskiego Street (70-481, Szczecin, Poland). The data entered during the chat, including personal data, may be stored for the logging function. Tidio states that it complies with the data protection provisions of the GDPR, Tidio is part of the EU-US Data Privacy Framework (“EU-US DPF”) and the Swiss-US Data Privacy Framework (“Swiss-US DPF”), which are committed to maintaining a high standard of data protection. Automated decision making, including profiling, may take place within the chat in order to predict your behavior or concerns so that we can provide you with the best possible benefit from the chat function.  (i.e. to enable you to take advantage of our benefits and support your use). 

 

9 Data security 

We take appropriate technical and organizational security precautions to protect your personal data from unauthorized access and misuse. When transferring data online, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS.

 

10 Rights of the data subject 

If you have given us your consent to process your personal data for specific purposes, we will process your data within the scope of this consent, unless we have another justification.

You can withdraw your consent at any time by sending an e-mail to the address given in the legal notice. Data processing that has already taken place is not affected by this. 

Please note that the exercise of these rights may conflict with contractual agreements and may have consequences such as premature termination of the contract or cost consequences. We will inform you in advance if this is not already contractually regulated. 

In addition to withdrawing your consent, you also have the rights under the applicable data protection legislation. These are (Chapter II GDPR):

Every data subject also has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

 

11 Changes to our privacy policy

We reserve the right to make changes to this privacy policy at any time. The new privacy policy applies from the time it comes into force by the provider.
